I'm only going off of what you're saying here but they can't sell a fake promise. Eligible gamers refers to the first 50,000 "gamers" who purchase it in my opinion. This is ripe for a lawsuit if they deny people access.
I don't know what Sunday Ticket Max is. Perhaps the code limits you to just your favorite team for the season with Max being all games. That would be a good way to bait people into the purchase of the $350.
