Earlier this year, Dolphins defensive end Phillip Merling allegedly committed aggravating battery against his pregnant girlfriend. On Tuesday, reports emerged that the charged were dropped.
So it means that Merling didn’t do it, right?
The alleged victim stopped cooperating with authorities. The fact that she has since moved to South Carolina has prevented prosecutors from forcing her to testify via subpoena.
“With the state unable to provide the complaining witness, Broward Circuit Judge Geoffrey Cohen would not grant another continuance in the case and the state was forced to drop the charge,” Broward State Attorney’s Office communications manager Ron Ishoy said in a statement, according to the Miami Herald.
It’s hardly an exoneration of Merling. Instead, it’s an apparent failure of the system.
