FORT LAUDERDALE, Fla. -- Prosecutors have dropped a felony aggravated battery charge against Miami Dolphins defensive end Phillip Merling.

Authorities have been unable to serve her a subpoena to have her return to Florida to testify against him.

A judge wouldn't grant another continuance since the state wasn't able to provide a complaining witness. So, prosecutors say, the state was forced to drop the charge.

Hmm... Technicality. Go figure. He's out of trouble, but he'll still have to face the court of public opinion.

Finally, now that this crap is behind him hopefully he can get his budding career back on track. This guy was a beast up front for us his first two seasons, I hope he can get healthy and back out there. Merling is stout against the run and is a Jet killer, both things we will need later this season because we are dinged up at DE right now.

Lack of victim cooperation results in dismissal of Phillip Merling’s battery charges
Posted by Mike Florio on November 17, 2010, 5:33 AM EST

Earlier this year, Dolphins defensive end Phillip Merling allegedly committed aggravating battery against his pregnant girlfriend. On Tuesday, reports emerged that the charged were dropped.

So it means that Merling didn’t do it, right?

Not exactly.

The alleged victim stopped cooperating with authorities. The fact that she has since moved to South Carolina has prevented prosecutors from forcing her to testify via subpoena.
“With the state unable to provide the complaining witness, Broward Circuit Judge Geoffrey Cohen would not grant another continuance in the case and the state was forced to drop the charge,” Broward State Attorney’s Office communications manager Ron Ishoy said in a statement, according to the Miami Herald.
It’s hardly an exoneration of Merling. Instead, it’s an apparent failure of the system.
